Pitstop Pro offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, vendors, customers, merchants, and/or contributors of content.

SECTION 1 – ONLINE STORE TERMS

SECTION 5 – PRODUCTS OR SERVICES

SECTION 6 – FREIGHT SHIPPING & DELIVERY TERMS

Most heavy equipment ships via freight carrier.

Customer is responsible for unloading at delivery. Forklift, skid steer, or dock service may be required.

Liftgate service may be available for smaller freight (not vehicle lifts) for an additional fee.
-
Customer is responsible for any re-delivery charges if delivery cannot be completed.

All shipments must be inspected upon arrival before signing the Bill of Lading. Damage or shortage claims must be reported within 48 hours.

Carrier delays, weather, or supply chain disruptions are outside our control and do not constitute breach of contract.
SECTION 7 – BACKORDERS & AVAILABILITY

Some items may be on backorder.

If an item is out of stock, restock times are determined by the manufacturer.

An estimated restock date will be provided by email after purchase or upon request.

Customers are encouraged to contact us before ordering if delivery timing is critical.

Orders canceled due to backorder are treated as cancellations and subject to the same 3% processing fee.
SECTION 8 – CANCELLATIONS & REFUNDS

Within 24 hours of order placement: Eligible for a full refund.

After 24 hours but before shipment: Orders may be canceled but are subject to a 3% non-refundable processing fee to cover bank/credit card charges.

After shipment: Orders are treated as returns, subject to freight charges and restocking fees (up to 20%, depending on supplier).

Refunds are issued to the original payment method. Processing time: 5–10 business days (credit cards), up to 48 hours (PayPal).
SECTION 9 – RETURNS & RESTOCKING FEES

Returns must be initiated within 30 days of delivery.

Items must be unused, in new condition, and in original packaging.

Customers are responsible for return freight costs.

Shipping fees are non-refundable.
-
Supplier restocking fees (typically 15–20%) apply.

Unauthorized returns will not be accepted.
SECTION 10 – SUPPLIER-SPECIFIC POLICIES
Certain brands (including but not limited to Katool, AMGO, Tuxedo, and Atlas) have supplier-specific shipping, cancellation, and return policies. By purchasing these items, you agree to those supplier terms in addition to Pitstop Pro’s Terms. Where there is a conflict, supplier policies govern.
SECTION 11 – PAYMENT TERMS

We accept major credit cards, PayPal, wire transfers, and certain financing options (e.g., Affirm).

Payments made by Affirm or similar financing providers may incur additional non-refundable processing fees (up to 6%) if canceled.

Wire transfers may qualify for discounts but are non-refundable once processed.
SECTION 12 – LIMITATION OF LIABILITY
Pitstop Pro is not liable for:

Shipping delays or carrier errors.

Manufacturer backorders or supply chain issues.
-
Indirect, incidental, or consequential damages, including lost profits, due to late or failed delivery.
SECTION 13 – FORCE MAJEURE
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, port delays, tariffs, strikes, labor shortages, pandemics, or carrier disruptions.
SECTION 14 – GOVERNING LAW & VENUE
This Agreement and any disputes arising out of or related to your use of this site or your purchase of products from Pitstop Pro shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law rules.
You agree that the exclusive venue for any legal action or proceeding arising under this Agreement shall be the state or federal courts located in Georgia, and you consent to the jurisdiction of such courts.
